General terms and conditions of Tandartspraktijk Leidschendam

  1. The general terms and conditions form an inseparable part of the treatment agreement(s) between Tandartspraktijk Leidschendam, hereinafter referred to as the 'care provider', including its employees, and the patient, hereinafter referred to as the 'agreement'. They are made available to the patient or his legal representative(s) before or at the conclusion of the agreement(s), are present in the waiting room and are sent on request.

Third parties

  1. The care provider is entitled to engage third parties in the execution of the agreement. It will exercise due care in choosing these third parties and, if reasonably possible, consult with the patient in advance, with the exception of observers and dental technicians. Tandartspraktijk Leidschendam is not liable for the conduct of these third parties. Articles 7:404, 7:409 and 7:422 paragraph 1 of the Dutch Civil Code do not apply.


Costs and payment

  1. The costs of treatment, including the costs of technology and materials, are charged and payable by the patient, regardless of whether he or she can declare the costs in whole or in part to a health insurer and whether these costs are reimbursed to the patient. The costs of treatment of minors will be charged to and payable by the legal representative(s).
  2. Unless otherwise stated, Tandartspraktijk Leidschendam calculates the costs of treatment in accordance with the standard price list it uses, which is available for inspection at the care provider's practice. We reserve the right to make changes to the standard price list. If a change in the rates on the standard price list results in a price change for the agreed treatment, the patient will be informed of this - in writing and/or digitally - prior to the treatment.
  3. Appointments must be cancelled – if necessary due to force majeure – at least 24 hours before the treatment on working days. In the event of non-cancellation or late cancellation of the appointment, the care provider is entitled to charge the reserved time and/or the agreed treatment if no other patients could be treated or other paid work could be carried out at a rate of 7.50 euros per five minutes, with a maximum of 125 euros.
  4. Payments must be made within 30 days of the date of the patient's declaration. Payments made by the patient always serve first to settle interest, damages and costs owed and then to settle due and payable invoices that have been outstanding the longest, even if the patient states that the payment relates to a later invoice. If there is an advance payment, this will be offset against the last invoice under the agreement. Notwithstanding the foregoing, the healthcare provider is always entitled to demand immediate and/or cash payment.

Treatment and information

  1. Prior to any extensive and/or radical dental treatment involving costs of €250 (in words: two hundred and fifty euros) or more, the patient or his legal representative will be provided with a written and/or digital quotation, containing a description of the services to be performed by the care provider for the relevant treatment, the rate to be charged per service, as well as the expected material and technical costs. The material and technical costs can only be an estimate, because Tandartspraktijk Leidschendam is dependent on third parties for this. When using gold or other alloys, the supplier's current price at the time of delivery applies. For the other technology prices and services, the final amounts may deviate from the budgets by a maximum of 10 percent. If prior provision is not reasonably possible, the care provider is not obliged to provide the aforementioned prior written and/or digital quotation, provided that the costs of the treatment in that case - unless this is also not reasonably possible - must be paid prior to the work with the patient and/or his legal representative(s) has been discussed.

In the event of a change in the treatment plan, unforeseen complications during treatment or exceeding the budget, the care provider will inform the patient in writing.
The patient is obliged to provide all information and documents that the healthcare provider deems necessary for the execution of the agreement, in a timely manner and in the desired form and manner.
The additional costs and additional treatment costs resulting from the delay in the execution of the agreement, arising from failure to provide the requested data and documents, not to do so on time or not to provide them properly, will be borne by the patient. The patient guarantees the accuracy, completeness and reliability of the data and documents made available to the healthcare provider.
At the patient's request, the care provider records in writing the procedures for which the patient has given permission, whether radical or not.

Complaints and claims

  1. Complaints regarding invoices must be submitted in writing to the healthcare provider within eight days of the invoice date, failing which the patient is deemed to have accepted the invoice as correct. Submitting a complaint regarding an invoice does not suspend the payment term and obligation. Setoff with counterclaims is not permitted. The same applies to complaints submitted to the Dentistry Complaints Committee or any other body.

Exceeding payment term

  1. If the patient has not met his payment obligations, not on time, not properly, or only partially, the patient is always immediately in default, without any further notice of default being required and the amounts due are immediately due and payable. In that case, the patient owes the care provider the statutory interest over the period of default, as well as all costs that the care provider must incur to collect his claim, whereby the extrajudicial costs are set at 15% of the amount due, with a minimum of Euro 100, without prejudice to the right of the healthcare provider to claim full damages.
  2. In the event of payment arrears, the care provider is entitled to suspend further treatment or only provide it in return for cash payment.

Guarantee

  1. Dentistry is a medical profession. Despite the utmost care of the healthcare provider, the outcome of a treatment can never be predicted with complete certainty. As far as possible, the healthcare provider will inform the patient of the risks in advance. We apply a warranty period of 5 years on crown, bridge and implant work, 2 years for a new prosthesis and 1 year for composite restorations. This warranty can only be claimed if the patient visits the healthcare provider at least once a year for a check-up and any maintenance. The warranty expires if third parties make changes to the workpiece. The form of the warranty will be discussed in a joint meeting between the parties.

Liability

  1. The liability of the care provider is limited to the amount to which the professional liability insurance taken out by the care provider gives entitlement, plus the amount of the care provider's deductible under the insurance. If desired, the patient can view this policy at the care provider's practice.
